Physician license in jeopardy for selling audio remedies online

A California doctor may need immediate professional license defense strategies to avoid losing his license. The physician sells controversial remedies over the internet and the Medical Board of California has taken notice, according to news reports.

The doctor, who is accused of "gross negligence and repeated negligence," reportedly sells what is called "eRemedies" over his website. These cures consist of simple MP3 audio files that patients can download to their personal devices. The doctor's website states that these technological remedies are based on homeopathic principles.

After patients answer a series of detailed questions, an algorithm chooses a treatment from among 263 eRemedies, which the doctor is selling for five dollars each. Patients then receive recommended protocols for how to use the 13-second sound waves to find relief from their ailments. The list of conditions that the eRemedies are said to cure includes:

  • Ebola
  • Malaria
  • Menstrual pain
  • Head injuries
  • Pet bladder infections
  • Anxiety
  • Typhoid

The medical board is seeking a hearing to address the matter, stating that the doctor sells the remedies even though the Food and Drug Administration (FDA) has not approved the treatments. Other allegations against the doctor include not providing a valid prescription and not examining patients before selling them a treatment. The board also noted a lack of scientific evidence that remedies can be transmitted via sound files.

While this doctor likely believes that his audio treatments truly help people, he will need a solid professional license defense to escape the situation with his career intact. This case looks like a good example of how belief in a principle may not overcome board regulations, especially without professional legal assistance.
