The California Board of Registered Nursing (BRN) is the agency that oversees nursing practice in California. Under the umbrella of the Department of Consumer Affairs, the BRN licenses and regulates registered nurses and certified advance practice nurses. The BRN enforces and regulates nursing practices under the Nursing Practice Act. Complaints that nurses face include:

  • Allegations of gross negligence while caring for patients
  • Conviction of a misdemeanor or felony
  • Abuse of alcohol or drugs
  • Diversion of controlled substances

Complaints against nurses may be filed by patients, family members, co-workers or employers. If a nurse is terminated for cause, the employer is required to report the termination to the BRN. Once a complaint is made, the case will be investigated either by the Department of Consumer Affairs or by a BRN special investigator.

If a nurse is convicted of a crime such as driving under the influence (DUI), that conviction will be reported to the BRN, which will trigger a disciplinary action. A DUI conviction or any conviction involving use or possession of drugs and alcohol is considered a violation of the Nursing Practice Act.
